Bitcoin price today moved back toward $76,500 as investors assessed stronger-than-expected Democratic gains in the US midterm elections and their potential impact on cryptocurrency legislation. The decline reflected concerns that a change in congressional control could delay the Clarity Act, increase scrutiny of the industry and make it harder for President Donald Trump’s administration to establish durable pro-crypto rules.

Bitcoin declined toward $76,500 on Wednesday after trading as high as approximately $77,950 during the previous session. The cryptocurrency initially recovered alongside technology stocks but lost momentum as early election results suggested Democrats could perform better than markets had expected.
Bitcoin was recently trading near $76,000, down around 1% from the previous close. Its intraday range extended from approximately $75,850 to $77,950, reflecting elevated volatility as election results continued to arrive.
The move leaves Bitcoin close to the one-month low reached earlier in the week. The cryptocurrency has struggled to sustain a rebound above $78,000 following the Binance security breach, ETF outflows and pressure from elevated Treasury yields.
US equity futures also moved lower. S&P 500 futures fell approximately 0.5%, while Nasdaq futures declined about 0.9%, indicating a broader reduction in risk appetite rather than a crypto-specific sell-off.
Democrat Roy Cooper flipped North Carolina’s Senate seat, defeating Republican Michael Whatley. The result marked the party’s first Senate pickup of the night and reduced the number of additional seats Democrats need to gain control.
Democratic Senator Jon Ossoff also won reelection in Georgia, while Chris Pappas retained New Hampshire’s open Senate seat for the party. Several other battleground races remained unresolved, leaving control of both chambers uncertain.
The market impact comes from the possibility that Democrats could win the House, Senate or both. Such an outcome would give the party greater power to investigate crypto companies, block legislation and scrutinize the Trump administration’s financial ties to digital assets.
A divided government could still produce bipartisan crypto legislation, but the process would likely become slower and more complicated.
The Digital Asset Market Clarity Act is one of the crypto industry’s most important legislative priorities. The bill would establish a federal market structure for digital assets and place much of the oversight of crypto spot markets under the Commodity Futures Trading Commission.
The proposal stalled during the current congressional session after Senate Democrats declined to support its advancement. Their concerns included the absence of stronger ethics rules addressing cryptocurrency holdings connected to the Trump family.
A Democratic victory in either chamber would make it more difficult to revive the existing version of the bill. Any new proposal could impose tougher requirements on decentralized finance, vertically integrated crypto businesses and conflicts of interest involving public officials.
The industry may therefore face a longer period of regulatory uncertainty. Rules introduced by federal agencies during Trump’s second term could also be easier for a future administration to reverse if Congress does not turn them into legislation.
However, the risk should not be interpreted as an immediate ban on cryptocurrency activity. Digital assets now have broader support from financial institutions, and some incoming Democratic lawmakers are considered open to establishing clearer regulations.
Political uncertainty is arriving while institutional demand has already weakened.
The latest available data showed that US spot Bitcoin ETFs recorded approximately $398.6 million in net outflows. BlackRock’s iShares Bitcoin Trust accounted for about $405.3 million of withdrawals, while Fidelity’s fund attracted approximately $6.7 million. Most other products reported no significant net movement.
The outflows suggest that institutional investors remain cautious after Bitcoin broke below $80,000. They also reduce an important source of daily demand that previously helped absorb selling from short-term holders.
Nevertheless, substantial amounts of Bitcoin have recently been transferred away from exchanges and into self-custody. Lower exchange balances could eventually restrict the supply available for sale if demand returns, although this factor has not yet produced an immediate price recovery.
The first important support zone is located between $75,500 and $76,000. A sustained break below this range could expose $74,000, followed by the psychologically important $70,000 level.
On the upside, Bitcoin must first recover $78,000. A close above that level could allow buyers to challenge $80,000, which has shifted from support to resistance following the latest sell-off.
A stronger recovery would require renewed ETF inflows, stabilizing technology stocks and evidence that the election result will not permanently block market-structure legislation.
The immediate direction of Bitcoin price today will depend on the final balance of power in Congress. A divided government could ease some concerns by limiting either party’s ability to introduce sweeping regulatory changes.
A decisive Democratic sweep could initially place additional pressure on crypto-related assets by reducing expectations for rapid passage of the Clarity Act. However, the longer-term effect will depend on whether the next Congress pursues restrictive regulation or negotiates a new bipartisan framework.
Traders will also watch US employment and services data. Strong economic figures could lift Treasury yields and pressure Bitcoin further, while softer data may support risk assets by reducing expectations for additional Federal Reserve rate increases.
